Terms of Services

Welcome to AVMScript (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our AVMScript software and related services (collectively, the “Services”). By purchasing, accessing, or otherwise using our Services, you (“Client,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, you may not purchase or use the Services.


1. ACCEPTANCE OF TERMS

By purchasing or using AVMScript, you agree to comply with and be legally bound by these Terms. We reserve the right to update or modify these Terms at any time, and your continued use of the Services after any such changes indicates your acceptance of the new Terms. If at any time you do not agree with the changes, you must stop using our Services immediately.


2. LICENSE AND USAGE

  1. License Grant
  2. Upon purchase, we grant you a non-exclusive, non-transferable, revocable license to install and use AVMScript on the licensed domain(s) that you register under your user panel.
  3. Licensed Domains
  • Each license is valid for a single domain, unless you have purchased multiple licenses.
  • You may change your licensed domain through your user panel if needed; however, certain limitations may apply (e.g., frequency of changes).
  1. Reseller System
  • You may choose to upgrade your account to a reseller account by paying the applicable reseller fee.
  • As a reseller, you will be eligible to purchase AVMScript licenses at a discounted rate for as long as your reseller status remains active.
  • Resellers are responsible for supporting their own customers unless you or your customers purchase support tickets directly from us.
  1. Prohibited Resale
  • You may not sell or redistribute AVMScript licenses as though they are your own product.
  • All sales of licenses must clearly identify AVMScript as our product.

3. SCRIPT UPGRADES

  1. Upgrade Fees
  2. We may release updated versions of AVMScript from time to time. You may purchase an upgrade to the latest version by paying the applicable upgrade fee.
  • Purchasing an upgrade is optional and not required for continued use of your existing licensed version.
  • We do not automatically charge you for upgrades unless you expressly request them.
  1. End-of-Life Support
  2. Once an older version reaches its end of life, we may no longer provide support or fixes for that version. You may upgrade to a supported version at any time by paying the upgrade fee.

4. SUPPORT SERVICES

  1. Free Support
  2. We offer free support for basic inquiries and non-technical questions. Support channels and methods for free support are at our discretion and may include community forums or limited email assistance.
  3. Paid Support
  • Technical support beyond basic troubleshooting is offered through our paid support ticket system.
  • You may purchase support tickets as needed. Each ticket covers assistance for a specific issue, problem, or request within a reasonable scope, as determined by us.
  • Paid support does not guarantee resolution if the reported issue is caused by factors outside of our software or control (e.g., server configuration, third-party modifications).
  1. Reseller Responsibilities
  2. If you are a reseller, you are expected to provide first-line support to your customers. If additional assistance is needed, either you or your customers may purchase support tickets from us.


5. PAYMENTS AND REFUNDS

  1. Pricing
  • The prices for AVMScript licenses, reseller fees, upgrades, and support tickets will be stated at checkout or in your user account.
  • We reserve the right to modify pricing at any time. Changes to pricing will not affect purchases already made.
  1. Payment Terms
  • All payments must be made in full at the time of purchase, via the payment method(s) we designate.
  • By providing your payment information, you represent and warrant that you have the legal right to use the payment method selected.
  1. Refund Policy
  • All sales of AVMScript licenses and reseller fees are generally considered final and non-refundable.
  • Requests for refunds will be handled on a case-by-case basis at our sole discretion.
  • Support tickets are typically non-refundable once purchased, unless no support was provided due to an error on our part.


6. CLIENT RESPONSIBILITIES

  1. Compliance with Laws
  2. You agree to use AVMScript and any related services in compliance with all applicable laws, regulations, and industry standards. We are not responsible for the content you or your end-users send or host using our software.
  3. Security and Updates
  • You are responsible for securing your hosting environment and any associated installations.
  • You are encouraged to keep your AVMScript updated to the latest version to benefit from new features, security patches, and improvements.
  1. Prohibited Use
  • You may not use AVMScript for any illegal, abusive, or unauthorized activities.
  • You may not engage in activities that harm or disrupt our Services, servers, or networks connected to AVMScript.


7. AFFILIATE PROGRAM

  1. Affiliate Enrollment
  • We offer an affiliate program that allows you to earn commission by referring customers who purchase AVMScript through your unique affiliate link or code.
  • To become an affiliate, you must apply and be approved by us. Approval is at our sole discretion.
  1. Commission Structure
  • Commission rates and payment schedules will be outlined in the affiliate program details provided upon approval.
  • You are responsible for providing accurate payment information in order to receive commissions.
  1. Prohibited Promotions
  • You may not use unethical, misleading, or illegal methods to promote AVMScript.
  • This includes, but is not limited to, spamming, unauthorized email campaigns, or deceptive advertising.
  • You may not misrepresent AVMScript as your own product or otherwise mislead potential customers about the nature of the product.
  1. Right to Ban Affiliates
  • We reserve the right to ban or terminate any affiliate account at any time and for any reason, including but not limited to suspected fraud, breach of these Terms, or unethical promotional practices.
  • If your affiliate account is banned, you forfeit any unpaid commissions that may have accrued up to the date of termination.
  1. No Ownership Claim
  • Affiliates must clearly represent that they are referring or promoting AVMScript on our behalf and must not claim ownership of the script or its licenses.
  • Any violation of this clause may result in immediate termination of your affiliate status.


8. INTELLECTUAL PROPERTY

  1. Ownership
  2. All content, design, features, and functionality of AVMScript (excluding any third-party components) are our exclusive property or the property of our licensors.
  3. Limitations
  • You may not sell, resell, redistribute, or sublicense the script except as permitted under your reseller agreement or license with us.
  • You agree not to reverse-engineer, decompile, or otherwise attempt to derive the source code of AVMScript, except to the extent allowed by law.


9. DISCLAIMER OF WARRANTIES

AVMSCRIPT IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT AVMSCRIPT WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY ERRORS WILL BE CORRECTED.


10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUES, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF AVMSCRIPT SHALL NOT EXCEED THE AMOUNT PAID FOR THE SOFTWARE LICENSE OR SERVICES OUT OF WHICH THE CLAIM AROSE.


11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents, from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in any way related to your use of AVMScript, your violation of these Terms, your promotional activities as an affiliate, or your infringement of any intellectual property or other right of any person or entity.


12. TERMINATION

  1. Termination by Us
  2. We reserve the right to suspend or terminate your license, your reseller status, your affiliate status, or access to the Services at any time, with or without notice, if we suspect you are in breach of these Terms or engaging in unauthorized or illegal activity.
  3. Effect of Termination
  4. Upon termination, the license granted to you will immediately cease, and you must discontinue all use of AVMScript and destroy any copies in your possession. The termination of these Terms will not limit any of our rights or remedies at law or in equity.


13. GOVERNING LAW AND DISPUTE RESOLUTION

  1. General Governance
  2. These Terms shall be interpreted and enforced in accordance with generally accepted legal principles, without regard to specific jurisdictional provisions.
  3. If any dispute, controversy, or claim arises out of or relates to these Terms, or the breach thereof, the parties shall attempt to resolve it through good-faith negotiation.
  4. Coordination with Authorities
  5. We reserve the right to cooperate with law enforcement agencies or other relevant authorities if a major issue arises, including but not limited to suspected fraud, illegal activity, or other violations of law.
  6. No Specific Jurisdiction
  7. Nothing in these Terms shall be construed to limit either party’s ability to initiate a claim in any appropriate jurisdiction. Each party may seek remedies where available under applicable law.
